In the first time ever in the history of Indian judiciary, four senior sitting judges – Ranjan Gogoi, Kurien Joseph and Madan B Lokur; Justice Chelameswar held a press meet and spoke against Chief Justice of India and alleged the country’s top court was not in order. They said they were compelled to do this.
“Many things which are not desirable happened in the last few months. We tried to persuade the Chief Justice of India that there is a need to correct certain things and remedial measures are necessary.
“CJI did not heed to our words. But we felt a need to protect this institution,” Justice J Chelameswar Rao said. he said the four of them were convinced that “for the survival of democracy an impartial judge and justices are needed”. They questioned the conduct of CJI Deepak Mishra, and allocation of cases. They said the CJI is the first among the four equal SC judges and he is no less or no above.
The judges presented the media a seven page letter they had writer to the CJI mentioning certain judicial orders had affected the judiciary system and the independence of High courts. The letter also mentioned the biased allocation of benches to certain cases. This must be prevented at any cost.
